Terms of Service

Please read these terms carefully before using ClarioFin. By using our app or website, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the ClarioFin mobile application, website, and related services (collectively, the "Service"), operated by ClarioFin ("we", "us", "our"). By creating an account, downloading the app, or using the Service in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. We reserve the right to refuse service to anyone for any reason.

2. Description of Service

ClarioFin is a personal finance management application that provides:

  • Bank account aggregation (connecting Monobank today; other Ukrainian banks coming post-launch)
  • Transaction tracking, categorization, and spending analytics
  • AI-powered financial insights and a conversational financial assistant
  • Savings goals ("Jars") with collaborative and auto-deposit features
  • Receipt scanning and automatic expense extraction
  • Multi-currency support with real-time exchange rates

ClarioFin is a read-only financial tool. We do not move money, process payments, or act as a bank, financial advisor, or licensed financial institution. ClarioFin provides informational tools only.

3. Eligibility

You must be at least 16 years of age to use ClarioFin. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are under 18, you confirm that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

4. Your Account

When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your login credentials secure and confidential — you are responsible for all activity under your account
  • Notify us immediately at support@clarioapp.net if you suspect unauthorized access to your account
  • Not create multiple accounts, share your account, or transfer your account to another person

5. Subscriptions & Payments

Subscription Tiers

ClarioFin offers three tiers of service:

  • Basic (Free): Limited features including 1 connected bank, basic analytics, and 5 AI queries per month
  • Pro ($3.99/month): Unlimited banks, advanced analytics, unlimited AI queries, data export
  • Elite ($7.99/month): All Pro features plus collaborative Jars, family access for up to 5 people, and priority support

Billing & Renewals

  • Paid subscriptions are billed monthly through the Apple App Store via In-App Purchase
  • Your subscription automatically renews each month unless you cancel at least 24 hours before the end of the current billing period
  • Prices are in USD and may be converted to your local currency by the App Store. Applicable taxes may apply
  • We reserve the right to change subscription prices with 30 days advance notice. Price changes do not affect your current billing period

Cancellation & Refunds

You may cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions on your iPhone). Upon cancellation, you retain access to paid features until the end of your current billing period. Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.

6. Bank Account Connections

When you connect a bank account to ClarioFin, you understand and agree that:

  • You authorize ClarioFin to access your bank account data (balances, transactions, account details) through your bank's API using the access token you provide
  • Your bank access tokens are encrypted at rest using AES-256-CBC encryption and are never stored in plain text
  • ClarioFin accesses your bank data in read-only mode — we cannot initiate transactions, transfers, or any changes to your bank accounts
  • You may disconnect any bank account at any time through the app settings, which will revoke ClarioFin's access to that account's data

7. AI Features & Limitations

ClarioFin uses artificial intelligence (powered by OpenAI) to provide financial insights, answer questions, and analyze spending patterns. By using these features, you acknowledge that:

  • AI-generated insights and advice are informational only and do not constitute financial, investment, tax, or legal advice. Always consult a qualified professional for financial decisions
  • AI responses may occasionally be inaccurate, incomplete, or outdated. You should verify important information independently
  • Your financial data (account balances, transactions, budget information) is sent to OpenAI's API to generate responses. OpenAI does not use API data to train their models
  • AI feature availability may vary by subscription tier and is subject to usage limits (Basic: 5 queries/month, Pro/Elite: unlimited)

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Attempt to gain unauthorized access to our systems, other users' accounts, or bank APIs beyond your authorized scope
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
  • Use automated scripts, bots, or scrapers to access the Service or extract data from it
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure

9. Intellectual Property

The Service, including its design, code, features, content, logos, and trademarks, is owned by ClarioFin and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

Your financial data remains yours. We claim no ownership over any personal or financial data you provide to the Service. You grant us a limited license to process your data solely to provide and improve the Service, as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

  • Accuracy, completeness, or reliability of any financial data, bank balances, transaction information, or AI-generated insights displayed in the app
  • Uninterrupted, timely, secure, or error-free operation of the Service
  • Compatibility with all banks, financial institutions, or third-party services
  • Fitness for a particular purpose, merchantability, or non-infringement

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLARIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR FINANCIAL LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

12. Termination

You may delete your account at any time through the app (Settings > Delete Account). Upon deletion, all your personal and financial data will be permanently removed from our systems via cascade deletion, as described in our Privacy Policy.

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we reasonably believe your actions may cause legal liability, harm to other users, or damage to our systems. We will make reasonable efforts to notify you before or at the time of suspension, unless doing so would compromise security.

13. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms in the app and on our website with a new effective date. If you continue to use the Service after changes take effect, you accept the revised Terms. If you disagree with any changes, your remedy is to stop using the Service and delete your account.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or relating to these Terms or the Service shall be resolved in the courts of Ukraine. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
